The power of attorney can be signed at a Spanish consulate or before a notary where you live, with an apostille and a sworn translation. We send you the wording ready to sign. Only the NIE has to be applied for in person, in Spain or at a Spanish consulate.

Frequently asked questions

Can you handle a property purchase if I am not in Spain?

Yes. We complete purchases and sales on your behalf with a power of attorney, so you do not need to travel to Spain for the signing. Only the NIE has to be applied for in person.

What happens if I inherit a property in Spain?

The inheritance has to be completed in Spain wherever you live. We deal with the certificates, the deed of acceptance before the notary, the inheritance tax and the registration of the property, also by power of attorney. Spanish inheritance tax is due within six months of the death; an extension can be requested within the first five months.

Do you handle divorces?

Yes, divorces by mutual agreement, where one or both spouses are foreign nationals or live abroad, including the division of what they own in Spain.

Do I need a lawyer to buy property in Spain?

It is not legally required, but it is strongly recommended. The Spanish notary does not act for the buyer: your own lawyer checks the Land Registry, the licences and the debts, and reviews the contracts before you commit.

What does a Spanish property lawyer do?

We review the reservation and private contracts, carry out the legal checks at the Land Registry and the town hall, deal with the notary and the bank, sign at the notary for you if needed, pay the taxes and register the title deed after completion.

What costs should I expect on top of the price?

Transfer tax on a resale property, or VAT and stamp duty on a new build, plus the notary, the Land Registry and our fees. We put the figures for your property in writing before you commit.

What is the difference between a gestoría and a lawyer?

A gestoría handles administrative paperwork. A lawyer gives you independent legal advice, reviews and negotiates the contracts, checks the title and represents you at the notary.

Do you work with clients in Valencia?

Yes. From our office in Jávea and our associated office in Dénia we act for clients with property in Valencia, in person or by power of attorney. We do not have an office in Valencia city.
